Boat Owner Agreement

Terms and obligations for boat owners listing on the CharterIO platform

This agreement governs the legal relationship between CharterIO (Platform) and boat owners (Owner) listing their boats for rental on the platform. By listing your boat on CharterIO, you agree to these terms.

1. Definitions and Parties

  • Platform: CharterIO website and related services (www.charterio.com)
  • Owner: Person or organization listing their boat for rental on the platform
  • Renter: User renting a boat on the platform
  • Booking: Confirmed rental agreement between Renter and Owner

2. Platform Role and Liability Limit

CharterIO is only an intermediary platform; it is not the boat owner and is not a party to the rental transaction.

  • The Platform connects Owners with Renters.
  • The rental agreement is directly between the Owner and Renter.
  • CharterIO is not responsible for the condition, safety, or suitability of the boat.
  • The Platform only provides mediation support for post-booking disputes.

3. Boat Owner Obligations

3.1. Accurate Information

  • All information in the boat listing (photos, features, capacity, equipment) must be accurate and up-to-date.
  • CharterIO may suspend accounts providing misleading information.

3.2. Boat Readiness

  • The boat must be delivered clean, safe, and ready for use on the reservation date.
  • All legal documents (registration, navigation permits, insurance) must be current.
  • Safety equipment (life jackets, fire extinguishers, etc.) must be complete.

3.3. Communication and Booking Management

  • Owners must respond to booking requests within 48 hours.
  • Confirmed bookings should not be unfairly cancelled.
  • Communication with Renters must be professional and respectful.

4. Insurance Requirements

MANDATORY: Commercial Insurance Policy

All boats listed on CharterIO must have a valid commercial insurance policy. This is the Owner's legal responsibility.

4.1. Insurance Coverage

  • Hull Insurance: Damage to the boat itself
  • Liability Insurance: Damages to third parties
  • Rental Coverage: Policy must cover commercial rental activities

Important: CharterIO is not responsible for the content of the Owner's insurance policy or whether the insurance company will pay compensation.

5. Commission and Payment Structure

5.1. Commission Rates

Commission deducted from each successful booking

Renter Service Fee

Charged separately from rental (does not affect Owner)

5.2. Payment Process

  • Payments are processed through Stripe secure payment system.
  • Net amount is transferred to Owner after commission deduction.
  • Payments typically occur within 7-14 business days after booking completion.

Important: Commission is non-refundable in case of cancellation. Full refund (including commission) only applies in force majeure cases.

6. Tax and Financial Responsibilities

Owner Tax Obligation

CharterIO is not responsible for boat owners' tax obligations. Income earned through the platform must be declared and taxed by the boat owner according to applicable local laws.

6.1. Income Declaration

  • Rental income from CharterIO must be declared under personal or corporate income tax.
  • Owners are responsible for preparing income declarations in accordance with local tax regulations.
  • CharterIO does not provide tax declaration or tax advisory services.

Important Note: Failure to fulfill tax obligations may result in penalties under local regulations.

7. Cancellation and Refund Policy

7.1. Cancellation by Owner

  • If a confirmed booking is unfairly cancelled by the Owner, a full refund is provided to the Renter.
  • Owners making unfair cancellations may have their accounts temporarily suspended.

7.2. Cancellation by Renter

  • If the Renter cancels, the refund amount is determined by the time remaining until the booking date.
  • CharterIO's 20% commission is non-refundable.

8. Force Majeure

Force Majeure Definition

Events beyond the reasonable control of parties including: natural disasters, pandemics, war, terrorism, civil unrest, strikes, government decisions, and transportation disruptions.

8.1. Cancellation Due to Force Majeure

  • In case of cancellation due to force majeure, a full refund is provided to the Renter (including commission).
  • All amounts except Stripe processing fees are refunded.
  • Neither Owner nor Renter bears compensation liability in force majeure cases.

9. Responsibilities and Obligations

9.1. Owner Liability

  • Owner is responsible for ensuring the boat is safe and complies with legal regulations.
  • Owner is responsible for accidents, injuries, or damages occurring during rental.
  • Damages to third parties are the Owner's responsibility.

9.2. Platform Disclaimer

CharterIO is not responsible for the boat's condition, safety, insurance coverage, or any issues arising after booking.

10. Jurisdiction and Applicable Law

10.1. Applicable Law

This agreement is subject to the laws of the country where CharterIO operates and international agreements. English and Welsh law applies to disputes between parties.

10.2. Competent Court

London Central Courts have exclusive jurisdiction for the resolution of all disputes.
